Legal Question in Real Estate Law in India

I entered into an agreement to byana on a stamp paper of Rs.100 in februry 2015 for a period of one year for execution of the sale deed. some payment was made by the opposite party in cash and a cheque of Rs.2 lakhs. Now I have paid all the amount back in cash and i donot have any records of that refund and a cheque of 2 lakhs was paid from my Mrs and my joint account. The time of byana period has also finished. The seventh clause of the byana says if the deal is not excuted within time, the earnest money will be forefeited. Can the opposite party can take any legal action against me?
