Legal Question in Real Estate Law in India

Recently I purchased a flat on ' A khata' land and the building plan was approved by BBMP. Now the builder is not giving the OC and Khata stating that it is not mentioned in agreement. I have taken a loan from nationalised bank for this .My question is can I file a legal case against the builder?

1) Occupancy Certificate is a must, without which u have to obtain by paying 50 per sqm for occupied built up area and 100 for deviations etc.

2) Issue legal notice, without OC, no flat can be occupied and it is his duty to handover the flat ready for occupation.
