Legal Question in Workers Comp in India

Dear Sir,

I am ex-employee of a leading real estate firm in mumbai. I resigned on 3rd.sept.2013. I served a 15days days notice as per the companies policy. the last day of my working was 17th.sept.2013. I was due to get the full & final settlement done after 45days which i should have got in the month of November.2013. Its 17th.Feb.2014 now but the company simply ignores my request to initiate the procedure for the settlement. Recently i got to know form the Hr manager that i would be paid only if any attendance was punch in at the biometric. But in the month of August.2013 i was transferred to the other bldg of the company hence i had to manually sign the register on daily basis which was under the supervision of my reporting manager. On the last day of my working, I had mailed the scanned copy of my attendance to my reporting manager which was approved & sent to the Hr team to be updated in thier records. But the Hr team now gives me an answer that what they have in their records would be paid to me it means they would only pay me for the days i have punched in at the biometric. I have sent all the required tread mails to my reporting manager & the Hr team for futher help. but i feel all is in vain. It feels like they dont want to pay me my deserved share. They in the month of January.2014 called my to the office to handover the Relieving letter but the last day of my working in thier records was 31st.august.2013 wherein i resigned on 3rd.sept.2013 & served the notice for 15days. Hence they told me they will call me back when the are ready with the updated letter but they failed to do so. They are now just playing the blame game. Blaming the other one for the task not done or updated in the records.

Please help me with regards to this trouble sir. I ma planning to take strict action against them.

Regards,

Yours Hopefully.
