Legal Question in Workers Comp in India

This is Vijay from Bangalore. My previous Organization have deducted PF every month (for 10 Months) and is reflected in the Salary Payslip. But they have not created the PF Account. Can I take action against that company

And

My last working day in that company was May 31st 2013. May month's salary was paid on 2nd July. Because of the delay I have faced so many problems. Could not pay my Loan EMI's, Credit Card bills, Home Utility Bills. Is there a section in the law which can help me in going against the company for delay in the salary.

Dear Vijay,

The Company is supposed to deposit the employer and employee monthly contribution of Provident Fund (PF) with the PF authorities. If the Company has not created your PF Account, you should initiate action against the Company.

The interest loss borne by you for the resultant delay in payment of your Loan EMI and Credit Card bills arising due to delay in payment of your salary, can and should be recovered by you from the Company.
