Legal Question in Appeals and Writs in Alabama

grandparents estate.

My uncle was left as executer. The estate is to be split between the three kids and my mom splits her share w me. He is tearing the place up, using the money and will not sell. Is there any way his position can be overturned?

Also do I have a say as to what goes on? I was given furniture that was supposed to be in will but wasn't. But the appliances were left to me. They have purposely destroyed all of them. The only thing I got out in the beginning was a mircowave and lamp. My uncle is doing it all out of spite so nobody gets anything. He says the will is airtight, my grandparents made sure and nobody can contest it. I am not doing this for any reason but to honor my grandparents wishes and them. Please help me find a way to appoint position to someone else. Thank You.

If he was executor of the estate, did he file to probate the estate? In the event he has, and you feel as if he is misappropriating assets of the estate, you can file that allegation for an accounting and to have him removed. You will need an attorney no doubt.
