Re: fiduciary duty vs. duty

Under Alabama law, generally each employee owes a duty to his or her employer to act in a manner as to not intentionally injure or damage one's employer -- i.e., you don't give the employer's confidential customer list and pricing schedule/strategy to a competitor.

An employee breaching their duty of loyalty may be called upon in a court of law to answer for any such resulting damages.

this duty is generally referred to as a "fiduciary" duty to that employer. Therefore, the two prongs of your Q seem to be the same issue. Hope this helps, but if I have misunderstood your Q, please feel free to follow up with me. Have a blessed rest of the week and Lord's Day, Chip
