Legal Question in Discrimination Law in Alabama

sex discrimination

Is it sex discrimination if you are excluded in business lunches or other types of more social events where networking and professional relations are built and business is conducted and you are told you are not included because the male/female 'thing' and it may not be perceived appropriate? I believe that has impacted my effectiveness in a position from which I was just released.

Re: sex discrimination

Based on what you've said, you could possibly have a claim based on gender discrimination. Alabama does not have a cause of action based on gender discrimination specifically, so you would need to meet the requirements to bring a claim under Title VII of the Civil Rights Act in federal court. Title VII only applies to employers with 15 or more employees. The various legal theories upon which a gender discrimination complaint can be brought are too many to discuss here. However, based on the facts as you stated, you should contact an attorney as soon as possible. There are several deadlines that have to be met if your case is viable. For example, a complaint must be filed with the EEOC before you can sue your employer. I'd be happy to discuss your case with you or refer you to another attorney if necessary.
