What happens to child support payments?

My daughter; age 9, has lived with her grandparents since 2 months of age.They have temporary custody now, I've been ordered to pay child support. I've fallen behind in payments. They have asked for full custody. If I sign over my rights, what happens with the back child support that I owe? Do I still owe it or what happens?

"Signing over" your rights may or may not relieve you of your responsisbility for back child support. It would depend on how the final order reads, changing custody or terminating your parental rights, whichever it is that you plan to do. Also, what about the father? There are several questions that would need to be answered before I could properly advise you.

Yes, you still would owe. As a general rule, child support payments, when incurred, become vested (permanently due). Thus, if you are considering a relinquishment of your parental rights, you should do so asap in order to minimize your liability for back child support.
