I have a 14 year old stepdaughter that was molested by the real dad. He is indicted on 3 counts of sexual abuse 1st degree. The judge has taken him out of the house but refuses to give the daughter back to the real mom on a full time basis because he had custody. She is living with the step mom and 2 sisters and she wants to live with me and her mom. What age does she have to be to make that decision? It is killing her to stay in that house and putting up with the step mom always telling her that he didnt do it. THis is the 2nd time these girls have been molested in this household. Last time by an uncle! No one wants to help this girl!

You need to file a motion in the court which gave custody to modify custody. You need an attorney to do this. If you do not have an attorney, I am in the Birmingham area.
