Legal Question in Civil Litigation in Alabama

Hi. I have given a check to a person 5 years ago for a property deal. The person never registered the property and returned the money back in checks after 5 years. Can we file cheating case against him? What are the options to retreive interest for money being withheld for 5 years?

No but if you have a deed to real property, that is all you need to show it is yours. If it is personal property, such as an automobile, you should have title. If it is other property, then if you have held that property for five years and that person took your money, there would be a presumption the property is yours and that is it. the other person would have to file suit to recover the property or determine the ownership.
