Legal Question in Legal Malpractice in Alabama

In 2005, I hired an attorney for a child support case. We went to court once and the father didn't show up. At the 2nd court date, my attorney didn't show up. (I called his office and his secretary told me that he was in court on a different case) We continued without him and my daughter was awarded $457 per month. I never recieved any payments and repeatedly contacted my attorney for years. Finally, in 2009, the attorney pulled my file and realized that the child support order never got signed and filed in court. He said it must have "slipped through the cracks". We went back to court and got the order filed. Now, almost a year later, I still haven't recieved a single payment. I don't know what to do and my attorney blows me off when I try to ask him about it. Please help.

This is more importantly about not getting the child support, not malpractice. I would suggest you contact DHR about obtaining the child support. If the father is employed, you can go back to court and have him arrested as well as get child support deducted from his payroll check and sent direct to you. You should be able to get retroactive child support. If you are in the Jefferson County, Shelby County area of Alabama, please contact me and I will be happy to assist as I may. Contact me through my web site telephone number.
