Legal Question in Medical Malpractice in Alabama

My friend went to the hospital sick, they said it was a virus, then the same day a few hours later he was rushed to Mobile,Al. for emergency surgery. Should he sue the local hospital?

Probably not, but it is difficult to tell without knowing more facts, i.e.: did your friend recover? Was your friend permanently injured as a result of the hospital's actions?

Medical liability claims are extremely difficult in this state. You have to employ various experts which are very expensive. The defendants rarely settle cases which makes them more expensive because the case has to be worked up for trial, and the expenses can reach anywhere from $50,000.00 and up. Most of these cases are "no harm, no foul". So, if your friend is doing better now, his damages are not great enough to warrant the cost of such a case. Additionally, it is very difficult to get a jury to award a substantial verdict in these types of cases.
