Legal Question in Personal Injury in Alabama

Passenger in Automobile accident

On October 16, 2002 I was a passenger of my sister's vehicle up in Alabama traveling to Birmingham from Tuscaloosa. An 18-wheeler merged over on us forcing us into a cement barrier at 70 mph. I went via ambulance to the UAB Trauma center and was admitted for severe neck sprain. I still suffer from pain and have another appointment with my orthopedic md. I was told I need an attorney but do I get one here in Florida or does the attorney have to be in the state the accident occured?

Re: Passenger in Automobile accident

Since the accident occurred in Alabama, you will probably need an attorney licensed in Alabama. However, if the trucking company is headquartered in Florida, you might be able to have a Florida attorney represent you. If you have an accident report, I will be glad to review it and discuss the same with you. You may call me in Birmingham, Alabama toll free at (888) 295-7409.

Your case will most likely be heard in Alabama and you will need an Alabama attorney. Most importantly do not try to represent yourself in this matter. The Trucker's insurance company will definitely try to screw you over. If you have any questions, I'd be happy to answer them at no charge. Please give me a call at 205-458-1100.

Sincerely,

Re: Passenger in Automobile accident

There is an outside chance you could bring the action in FL but typically an action for negligence is brought wherever the accident occurred. Most attorneys would be willing to handle this on a contingency fee basis-that is, they only get paid if they recover money for you, minus expenses for the case. There are many attorneys in this area who could handle this for you, including myself. A contingency fee arrangement could be anywhere from 25%-50% of damages awarded. I would suggest you contact several different attorneys up here in the Birmingham/Tuscaloosa area and shop around a bit for one you feel comfortable with and one who will give you a good deal on fees. If you would like to speak with me about the case, my number is 205-915-9991. Good luck.

Re: Passenger in Automobile accident

I recommend you retain a qualified litigation attorney experienced in personal injury and auto negligence law in Alabama where the incident occurred. I am a licensed Florida practitioner with offices in South Florida, but I know of several attorneys in Alabama that may be interested in your case. Did your sister suffer any injuries? Was the police contacted and an accident report prepared? Was the driver of the 18 wheeler cited for a traffic violation? I look forward to hearing from you. 305-445-0937.
