If there are no other assets, and therefore no need to open a formal probate estate, the Alabama Department of Motor Vehicles will generally transfer a title when presented with 1.) The original title, 2.) A copy of the death certificate, 3.) An MVT 5-6 (Next of Kin Form) completed and notarized, 4.) A "One and Same" affidavit completed if the name on the title is different in any way than the name on the Death Certificate, 5.) A Bill of Sale made out to the buyer and signed by the seller (If sold, if transfered for less than $50.00, it must be written as a "Gift" 6.) A valid photo ID of the person making the transfer (usually the buyer). That should do it. If you are transfering and a probate estate has been opened, the requirements are slightly different. This should all be done at the County License Office in the County where the buyer resides -Dean.
