Legal Question in Wills and Trusts in Alabama

Probate

My deceased mother left me all of her funds. (I shared her bank account so that seems simple enough.) She left my brother her home. No one contests this. Is there a need for probate?

Even though it probably would never be contested, it is always best to go ahead and probate a will. If you don't, someone can always contest it later and if it is found that you or another heir has had something they shouldn't have, criminal or civil charges can be brought. Just spend the time and money to do it right.
