Appeal a Decision

How do I appeal a decision where one spouse was granted legal fees, when the other spouse did not receive notie and the fees were extraorinary (7,500) for a pre-trial conferene?

If the "decision" was a court order or opinion, you have 14 days to file a motion for reconsideration in the circuit court, or you can file an appeal to the Michigan Court of Appeals, which is due 21-28 days from the date of the order, depending on the type of case, etc.

If your motion for reconsideration is denied, you can then appeal to the Court of Appeals. However, there is an "appeal by right" and an "appeal by leave" which are 2 different processes, depending on whether your order is considered a final order or not.

Your chances of success in any of the above situations depend on the background of your case and which route you take.

You really need to retain a lawyer to help you with this, as it is complicated and must be done timely and properly to even have a chance at winning.
