Legal Question in Employment Law in Arizona

paying back an overpayment

I was overpaid on my last paycheck by an amount of $776. I work in Arizona- Single - Non Exempt employee. I notified my employer the same day about the overpayment & asked if there was any way to repay it in installments. I didn't hear anything back from them until the other day. In which they said that they will be taking my full paycheck until the total amount is repaid. I was wondering if they were allowed to do so, or if they had to at least give me minimum wage & use the rest to repay the overpayment?

Re: paying back an overpayment

An employer has the right to deduct from a subsequent pay period any money they overpaid in a previous pay period. As long as the amount of money you actually earned meets the standards of the minimum wage requirements, they are allowed to take to repay a debt all the money you earned.
