Legal Question in Personal Injury in Arizona

pain and suffering paid to deceased

If a person is entitled to payment for pain and suffering resulting from an auto accident, but dies of unrelated causes before the case is settled, is he (now his estate) still entitled to payment for suffering incurred up to the time of his death?

Re: pain and suffering paid to deceased

An award for pain and suffering of an injured party is precluded upon their death. Should the death be attributable to the accident there may be a cause of action for wrongful death. I would suggest that you speak with an attorney directly regading this matter.
