Legal Question in Criminal Law in Arkansas

Court procedings - Misdemeanor

I went to court today (5/30), and before court started

the Prosecutor called me. He told me 1 officer was in

Mexico and asked if I wanted to Plea or still go to

trial. I told him I wanted the trial. He implied that

the continuance was automatic. He then came back to me

and told me my new date was 8/25, and he also told me the

other officer didn't show up either. What should I do?

Can I file a motion/ask to speak to the judge and ask for

a dismissal? After all I showed up, and they knew one of

their witnesses was out of the country. I know I probably

should have insisted on talking to the judge, but that is

hindsight now.

Re: Court procedings - Misdemeanor

You could have, but it is too late now. It would have been up to the judge who might have granted the continuance anyway, but you did have the right to ask.
