Legal Question in Family Law in Arkansas

Modifying Divorce/Custody Decree

I was initially granted custody of our 2 children. 4 yrs later I signed custodialship over to my ex, however I had no atty representation. He allowed the children to remain with me for the next 1 1/2 yrs. He then became upset that I finally started dating and took the children. Our divorce decree states that as long as he lives in the county he resides in he is responsible for transporting the children to/from me. He has failed to do this, so I drive 3 hrs round-trip each time they are here, which is at least every-other weekend. There are times when I make the trip 4x/wk so I can see them play in their baseball/soccer/basketball games. The transporting issue has not been addressed during any court hearings we've had. Is he in contempt of our ordered decree? I'm tired of going to court. Is there anything I can do to make him responsible for the transportation of our children?

It sounds to me like you got the short end of the stick. He got custody and then the kids lived with you for another year and half. Why?

The short answer without knowing more is that your only recourse is by going back to court.
