I HAD A CAR ACCIDENT WHEN I WAS RIDDING BIKE.THE POLICE OFFICER SAID:"THE ACCIDENT Happened BECAUSE OF THE HIGH SPEED OF CAR.AND THE CAR IS Guilty. BUT THE CLAIM REPRESENTATIVE( Insurance Agent)SAID:"WE will pay only 30 percent OF damage"

WHAT SHOULD I DO?

I'M A STUDENT IN UCSD.

Either settle or sue, those are your options. If you have substantial medical expenses from injuries in this collision, you would be well advised to hire an attorney to try to get full value on your case. Insurance companies seldom will settle for full value without the pressure of litigation, and certainly not if you are pro per. If the police report confirms your claims, then you should be able to overcome the current problem with the adjuster. If serious about doing this, feel free to contact me.

If you were not injured but only seek to recover money for the value of the bicycle, you might go to small claims court. Usually, the police report is not considered evidence, because it's the officer's opinion -- after the fact -- of what happened. But it should give you contact information of witnesses whom you should require to show up at trial to give his/her version of what happened and, in small claims court, the rules of evidence are relaxed so the judge might take a look at the police report. Typically a police report will be based on all of the evidence and statements made at the scene of the accident.
