Legal Question in Bankruptcy in California

Hello Mr. Cohen. My name is James Alonso, and I want to thank very much for answering my question. I'm sorry if I was not clear, but my question was, if I could file bankruptcy including my private student loans while in school? Not my government loans.

Dear James,

You need to have an attorney examine your specific situation, the loan documents and the loan program under which you received the private loans to see if the loans were insured or guaranteed by the government or a government program. Many so called "private" loans are in fact insured or guaranteed by a government program and therefore are not dischargeable in bankruptcy.

Also, there is what is called a Hardship Discharge but that is beyond the scope of your question and this discussion.
