Non refund of funds deposited to travel agency.

I deposited $800 to an internet travel agency based in Canada that offers discount trips. However, the agency paperwork indicates they are a registered seller in California. Their paperwork lists a CST#. They state if you cannot get your dates of choice they will return the deposit. My original selection of dates was not available. A year passed before I contacted them again to select another date. I have been trying since the end of March to contact them. They have not returned any of my emails or faxes. Their website is still functioning and there is a phone number on which is a message indicating to use email and fax as they are strictly an internet company. I have sent them numerous emails and faxes and have heard nothing back from them. All indications are that they are fully operational yet I cannot get a reply from the agency. What, if any, recourse do I have and what action should I initiate? My original deposit was in December 2002.

If they were licensed in CA, they might have a Registered Agent for Service of Process listed with the Secretary of State. Call and see. That is who you can serve on their behalf. Sue them in Small Claims court for the maximum, $5000, which should get their attention.
