Legal Question in Business Law in California

Last week, at Belle�s 17th birthday party on Venice Beach in Los Angeles, she met many new friends. One was named Chuck. Chuck said that he wanted to sell his car. It was a 2012 Mercedes 560 SLK. He said he said he was only asking $50,000 for it but it was worth much more. Belle said, �I will give you $45,000.� Chuck said, �No, you�re too young. But if you know someone older, perhaps your father, I could sell it to him.� Belle said, �OK, you win. I will give you $48,000 for it.� Chuck said, �Did you get older? You are too young, and you are a girl. This is a manly car.� Belle said, �Fine, I accept your offer. I will buy your car for $50,000. Done! Give me your bank details and I will transfer the money to you tomorrow.� Chuck left without saying a word. Two days later, Belle called Chuck and said �I still don�t have your bank details. How can I transfer you the money for the car?� Chuck responded, �Oh, I sold my car to someone else.� Belle said �But we had a deal! If you do not sell me your car, then you must get me a car just like it for $50,000 or I will sue you and my father�s a lawyer so you will be in big trouble.� Chuck hung up the phone. Three days later, Chuck found a 2012 Mercedes 560 SLK advertised online for sale. The asking price was $45,000. Chuck thought he had a great idea to make some money. Chuck bought that car for $45,000 then emailed Belle saying �I will deliver your new car later today.� Chuck drove over to Belle�s house and handed her the keys saying �We have a deal. Here is a car just like mine. Now, you can transfer me $50,000 within the next 3 days. Later that day, Belle went for a drive around Hollywood with her friend s Sarah (16 years old), Ricky (18 years old), and Tammy (26 years old), showing off her new car. They had so much fun. The car was fantastic. When she woke up the next morning, her mother said �Belle, I need you to send me $50,000 from your account so I can go shopping in Switzerland this weekend.� Belle said, �But then I won�t have enough money to pay for my new car. Oh, you�re such a mom! She rolled her eyes and stomped away.�

Belle thought about it, went to her computer and transferred the money to her m other�s bank account. Belle then emailed Chuck saying, �Sorry Chuck, I cannot buy your car after all. You should come and pick it up.� Chuck called Belle and said �Hey, you already bought the car. It is not mine, it is yours. Now you must transfer the money. We have a deal and a deal is a deal. I only bought that car because you said you wanted to buy it. I don�t want it back. Send me the money or I will sue you.� Belle said, �Hey, I�m really sorry. I�m just a little girl and don�t know anything so please just take your car back.� Chuck said, �Really? Don�t know anything? I think someone who has $50,000 in her bank account knows a lot. So, pay or get sued, the choice is yours.� Chuck then hung up the phone. Belle does not know what to do and needs your advice.
