Legal Question in Civil Rights Law in California

not served properly

We recently were served a summons

that was filed with the court on july

20,2007. There are a couple different

defendants listed- One of whom WAS

served- But we were not served until

March 1,2008. Don't you have to be

served within 120 days?? And what

do we do now? what do we file to

have them drop the case becasue of

this default?

You file an appropriate motion to quash, or whatever other motions may apply, depending upon the pleadings, facts and law. Is there a form for you to check some blocks? NO. Such motions must be properly drafted, supported by facts, declarations, points and authorities, and legal arguments sufficient to convince a judge to do as you request.
