Business License for a web-based only business?

I was wondering, am I required to have a local business license and fictitious name statement for a web based business?

The business only sells downloadable material and not tangible goods or services.

Yes, you do need a local business license.

You need a fictitious business name statement if you are doing business in a name other than your own, and you have not formed a corporation or partnership.
