Legal Question in Technology Law in California

Is it libelous to post the contents of emails I received from a company on-line?

The email(s) in question did not contain any copyright notices or NDA's.

I currently reside in California while the business in question resides in Massachusetts.

I have not yet posted anything but was planning on posting a long thread on a forum (containing the emails as proof) about my dealings with a company which sold me an item which they incorrectly sent. After returning the item they failed to send me the correct item and refused to refund my money (this is after many months of back and forth emails and phone calls).

Thank you,

John

You haven't given us enough information to answer your question. Whether posting those emails would be libelous will depend on what they say, as well as the context in which they were written and the context in which you post them.

Note that, even if the emails are not libelous, posting them could get you into legal trouble for other reasons. Even if the law is on your side, defending yourself can be exhausting and expensive.

In most instances, doing what you describe would be perfectly legal. But your instance might not be like most, especially since you seem to feel there's a risk. If you think there will be repercussions for posting the emails, you should consult with a lawyer first.

Good luck.
