i was wondering if u could help on a subject?

i had clear wire internet service and paid fuill price to own the modem so i dont have to rent!

i was not getting full bars and i sent it back to clear for repairs, they did not tell me if they find nothing wrong that they will keep it and not send it back and wont send me $$ or a new one that i have to go out spend more money and buy a new one!

they told me i should have checked the TOS!

They told me this and also in TOS after i sent it and found out 3 to 4 months later! (ii) your original Device will not be returned to you, (iii) you will not be entitled to receive any replacement Device under this Warranty Claim and Exchange Procedure, and (iv) you will be required independently to purchase another Device in order to resume your CLEAR service.

- is they any way to SUE or Get my device back or just give up and let them take it and just go buy a new one? what should i do! if there is nothing u can do or any help please lets me know!
