Legal Question in Construction Law in California

Kitchen cabinet falls off wall

Do I have any recourse for a kitchen cabinet that fell off the wall? The home

was built in 1991. Only three screws were used to secure the cabinet to the

wall. I contacted the cabinet builders and they told me they didn't install, but

only made them. The home builder told me tough, that's what home owners

insurance is for. I feel negligence was used in installing the cabinets and that

the builder should at least try to make it right. I since have added more screws

to all my other cabinets that were installed the same way.

Re: Kitchen cabinet falls off wall

The applicable statute of limitations would be ten years, at most, from the date of substantial completion of the construction work; see Code of Civil Procedure section 337.15. Hence there is a defense and an attempt to find recourse through a suit for negligence in the installation would fail due to being time-barred.
