Legal Question in Construction Law in California

Hello mr. McCormick I'm sorry my question was so vague basically my in laws are homeowners and we are renovating the garage to a living area we tried taking out a personal loan and was declined so our contractor let us know about the HERO program and all we had to do was sign some paperwork and fill out some information we were approved and he said that the renovation would be covered and not to worry about anything now all of a sudden we're starting to pay money out of our pocket when they have $69,000 of the hero money we still have not received an itemized ation list of what the work entails so basically we're at the point right now where they started the work in November and we are now in July and we are still not moved into the garage yet nor has it been converted they are abusing the HERO program because I found out that through the HERO program that is supposed to be used to update the house to conserve energy they are giving us a hard time to get this work done we would like it to be finished as soon as possible but we would also like our money back for the time we've invested all the money we've spent into this even though we have already taken out a loan of $69,000 from the HERO program it is not being used towards the itemized ation list that was given to the HERO program that included tankless water heater and such I'm not what I'm not sure what to do at this point and I was looking for advice I would like them to finish the work so that me and my partner can move into the garage and be settled but I definitely want to see them after the work has been done and I just want to know what I need to do on my end to get things rolling?

Well you have kind of a double edged sword here. If the contractor arranged the HERO loan with both him and your inlaws knowing it would not be used entirely for permissible HERO purposes, they could get in trouble if they report him to the HERO program. Your best bet is probably to file a complaint with the Contractor's State License Board and a claim against their license bond. You can get the information on their bond from the CSLB too. www.cslb.ca.gov
