Credit Card Purchase

My son is currently in Iraq with the Marines and has made me power of attorney. My son is married (in MA) but his current residency is in CA. My son's wife made a credit card purchase with a card that is only in her name. She was the only person who signed the contract. The charge was denied but she already had the merchandise. She has ignored the bill from the company and now it is in collection. Somehow the collection agency got my home phone in MA and has been calling me since his wife will not return the calls. I told them that they needed to contact her directly since the contract was signed by her and it was paid with her credit card. They told me that my son is just as liable for the charge since they live in CA -- common law. They said they will report this on his credit as well as hers if I don't pay it -- is this true or is the collection agency just trying make their money by scaring me -- I have heard this is how they operate. Please help me. Thanks.

This aggressive collection tactic is totally illegal. You should keep a journal of their collection efforts, and record their phone calls to you. You have federal and state rights to protect you (a neutral third party) from harrassing collection efforts.

You may wish to write them or have a lawyer do so.
