Legal Question in Consumer Law in California

If I gave an artist a large deposit to do a painting and because of circumstances do not want the painting done and she has not started anything or purchased supplies because she was waiting for a photograph of the people to be painted do i have a right to get back 90% of the deposit. She took half of the final price and now says that is hers to keep and she does not owe me anything. Unfortunately I did not get anything in writing

You may have a right to everything if there was no specific oral agreement (or written agreement). She may have a weak basis for keeping the deposit. If under $10,000 you can sue in small claims court and try to get it back.
