Legal Question in Consumer Law in California

Lemon Law

Does the California Lemon Law pertain to CD players too? I ask because I spent $60,000 on a brand new 2003 Mercedes and I have taken the car into the dealer to have it fixed 3 times And it keeps having the same problem.

Re: Lemon Law

Not likely covered. Tell them to replace it. I learned with my E320 that they will respond. Wish you well.

Re: Lemon Law

California has a large number of laws dealing with consumer remedies. Civil Code Section 1793.2 and 1793.22 are peculiarly applicable to your question. The latter section deals with your rights and remedies. If four or more attempts at repair are made or your vehicle downtime exceeds the limit set out in the statute and you have met the other requisite of these sections, you probably could claim the benefits of the Lemon law. I recommend that you read the code sections that I have listed. You can get them on-line or write me and I will provide them to you.

Best of Luck!

Re: Lemon Law

The best bet is to ask them to replace the cd changer. If that does not work you will need an attorney specializing in Lemon Law. My experience is that MB does not buy back unless a court judgment. Call if you have any additional questions.
