Legal Question in Consumer Law in California

selling online

Is it illegal to sell something online that I haven't yet in my possesion? I ran out of a shirt and sold one, and notified the buyer it would ship in two weeks. -the time it takes to get in next shipment. Is that illegal?

I sure think it is. When you sell someting at an auction, most reasonable people would assume the items you are selling are in your possession, or at least ready to ship. I think it is misleading to not disclose that the item is not in stock or inventory. It probably is not a crime, but it sure looks like deceit to me.
