Cingular unhelpful in fixing credit report mistake

Cingular wireless sent my wife to collections despite the fact that she had closed her account and we had an invoice indicating she owed no money. They never sent us any bills until we received a letter from the collection agency over one year after the money was supposedly due.

I wrote a letter to Cingular telling them to fix this and to make sure there was no record of this mistake on her credit report. They repored the debt as paid instead of correcting the report. I have sent them letters twice in the last 2+ months.

Cingular is indifferent to the problem and will not go out of their way to fix the issue after I warned them that I would report them to the PUC, the state Attorney General's Office, and that I would file a suite against them for libel as well as failure to comply with Fair Debt Collections Acts and Fair Credit Reporting Acts. Their response was that they ''could not find the account''.

I am looking for a Corporate Watchdog organization who would file suite against them in exchange for 1) contingency fees and 2) a donation of a large portion of any winnings.

Barring that, I would be interested in hearing from any experienced lawyer.

We're about to apply for a mortgage despite Cingular's report.

Have you filed written protests with the three credit reporting agencies? They are required to investigate and have the creditor verify the debt. If they can't find the account, then it should drop off.
