Legal Question in Credit and Debt Law in California

Motion Hearings

In keeping up with my case online, I read that a ''Hearing on Motion to/for Judgment on the pleadings filed by Arrow Financial Services LLC'' is scheduled for Feb. 22, 2008. I'm assuming this motion was asked for by the plaintiff. My question is do I need to attend?

Thanks!

Re: Motion Hearings

You should attend this. However, you need to file an opposition this motion. It should have been served on you several weeks ago. You need to go get a copy of the file from the court and you should consider a consultation with an attorney.

Re: Motion Hearings

If you are representing by an attorney, he or she should be handling this and you do not need to attend. If you are representing yourself, you should definitely attend.

When a plaintiff files a motion for judgment on the pleadings, it typically means they are alleging that you haven't filed an adequate answer to the complaint. You or your attorney shold have received copies of the motion and you should have filed opposition to the motion as well. If did not file papers or do not attend the hearing, the court may grant the motion and possibly even strike your answer.
