Legal Question in Criminal Law in California

My 12yo Son is being charged with violation of PC626.10(a)(1) with a sentence range of 16-2-3. This is his first offense of any kind and I just received a notice of hearing in the mail.

What are my Best and Worst case scenarios?

He had no knowledge of the knife being a felony (I don't even think he truly knows what a felony is). What are our options when putting forth a plea?

He had it in his back pack on school grounds. Two people at school knew he had it and turned him in to the office, once they searched his backpack, they found it there.

He has already been expelled behind it, even though we fought a long hard fight. Now, not even 30 days after his expulsion ruling, I get a " Petition-Ward Notice of Hearing"

What should I do?

Try to relax . I have done over 1000 juvenile matters, and if you want to call me at my office at 661-2671313, I can explain all the possible alternatives. I'm sorry to hear about the expulsion, but our schools do not know how to make good decisions anymore, and simply rely on a set of standards, even when they don't really apply. David Wallin
