Legal Question in Criminal Law in California

Currently on banked probation, completed all request by judge.

Hi,

I am finding that since 9/11 many companies are looking for a clean background check. I have already lost a great opportunity. I am currently on probation for 4 misdemeanors-Harrassing phone calls. I have satisfied the community service-paid the restitution. I was switched from regular probation to bank probation because they don't think they will have a problem with me. It's been one year now and i have 2 to go. Is there anyway of clearing my background before i finish probation? I am finding it difficult to find a position.

You can file a motion to modify the terms of probation, and request the court to reduce the probation time to one year and then terminate probation. At the same hearing you could request that the court expundge the convicition. Contact the probation department and ask if they have a procedure for expunging your record. Many probation departments charge a small fee to process the form after you fill it out.

Once you have completed probation, I can file a motion to expunge your record; the effect is to get you a dismissal of charges [understanding that this was one matter with four counts, not four seperate dated matters]
