Legal Question in Criminal Law in California

DA dropped charges, but a month later issue arrest Warrant.

My syster got arrested for shoplifting back in 2004. She went to court in September and told her all charges had been dropped. Yesterday, four years later, she is pulled over for a traffic violation and turns out there is a warrant for her arrest for not appearing in court in October 2004. She never got any papers and all charges were dropped in the Sept court. What gives? If this was the DA's mistake, can she claim her bail money back?

Of course. I would suggest getting a copy of the dismissal from the court back in 2004. When she appears, if she explains this to the judge, they can be lenient about this as well.

I do suggest you have counsel for this one, criminal charges are generally ones you do not want to 'go at' alone and the public defenders are too busy to really spend the time or care about any one client...sorry..I have friends that do it...but the truth is the truth.
