Expunge Record

Hi i was convicted of a drunk in public and assault in July of 2007. I was put two years of probation which will be over in July this year. My record is clean besides this and have not go in trouble since then. I go to school at Cal State Long Beach and volunteer regularly. For my major I am involved in working with kids and patients with disabilities. I volunteer at a place for individuals with disabilities, I enjoy it a lot but they cannot hire me because of my record and they said i have to get it expunged. I got a copy of my criminal records, but I am not sure how to go about this. I live in Long Beach and I wanted to see if there was any type of advice you could give me. thank

You may be able to get early termination and expungement. But, expunged convictions still have to be fully disclosed on applications for professional licensing, state credentials, bonding, background checks, etc. It will help to be able to say 'no' to convictions on most private employment applications. If you can obtain a letter that you cannot be hired because your conviction has not been expunged, you could use it for a motion to terminate your probation early. Your argument would be that continued probation is a hardship, i.e., prevents you from being gainfully employed.

Once your probation is terminated, you should be able to have the conviction expunged at the same time.

I would recommend you contact the lawyer who handled your case to file and argue the appropriate motions. My law firm and other attorneys would be available to handle something like this for you for a modest price as well. You could try to do it by yourself. You would need to find out what you need to do from the court clerk.

Your likelihood of succeeding on this is pretty high, if you have an attorney representing you.
