Legal Question in Criminal Law in California

felony reduced to misdemeanor. gun rights?

My husband was convicted about two years ago for statutory rape because of me, i got pregnant he received a felony well here it is two years after we're married with two kids we went in july of 04 and they took him off probation then in january of 05 we went back and they reduced his felony to a misdemeanor the judge said every body deserves a second chance. My husband is an avid hunter and every since he was convicted he hasn't been able to hunt because they took his gun rights away but since now it is a misdemeanor does he have his gun rights back???? Any comments would be helpful thank you !--name removed--P.

You raise a good question. While I am not sure myself, I know a lawfirm in Long Beach that may be able to handle your question. It has a focus on gun rights. It is called Trutanich & Michel. You can reach them at (562) 4441. Ask for Carl Michel or Carmen Trutanich and say you were referred by me from Law guru. Good Luck.

No, he does not automatically get his gun rights back. Under some limited circumstances, it may be possible to get a court order restoring them, depending on the facts of what has happened in his case. Contact me if interested in pursuing this.
