grand theft

My boyfriend has been accused of grand theft but he was given the car keys by the wife and told he could drive the car. But the husband came home early and filed a false police report stating that the car was stolen from the store where he had left the keys in the car and came out and it was gone. How do we prove it is a false report ? and if we can prove the report to be false will they dismiss the case or will it still go to a jury tril ? He

does have prior convictions for grand theft will the jury here about the priors or only the judge will no this info?

Your boyfriend needs a lawyer. Unless the prosecutor drops the charges he will have to go to trial. Convincing the prosecutor to drop the case will be difficult, and a lawyer will have a much better chance than your boyfriend would on his own. The odds of an acquittal at trial are also a lot better with a lawyer on board.

Reading between the lines, it seems likely that you are the wife who let your boyfriend borrow the car. You may want to talk to your boyfriend's lawyer about how this information can best be used in his defense. Don't call the prosecutor yourself unless the lawyer says you should.

And if you happen to have made any false statements to the police about what happened, get your own lawyer before you do anything else.
