Legal Question in Criminal Law in California

NRI problem

Dear Sir/Madam,

Iam an Indian living and working in USA with my spouse . I left India on 2-8-2011, My Brother filed a false case on 18-01-2012 (after 5months) accusing me under sections 406,420. Now court issued NBW. But I cannot go back to India atleast for the next 2 years, because my green card is under processing and I dont have visa stamping to reenter USA. Can I just appoint an advocate in India to appear at court and come out of the case without appearing in person in India? or is it mandatory that I must appear in person in Indian court? [My Brother is intentionally doing this so that when I go to India he wants me to get arrested and prevent me going back to USA and thus spoiling my future]
