Legal Question in Criminal Law in California

Probation and arrested for carrying a concealed weapon

My boyfriend has just been arrested for carrying a concelaed weapon in los angeles county. He is currently on probation for a GTA from a year ago. Other than that charge, he has on minor traffic violations, no criminal history and no violent crimes. Although about 5 years ago he was named in a Gang Injunction. Now aklong with the carrying a concealed weapon, they are trying to charge him with a Gang Enhancement''. I am unsure of what exactly this means or what kind of penalties it carries. Also, my boyfriend is extremely worried because another inmate told him that the state can give him 5 years for every bullet that was in the gun. Is this true? Even though the gun was registered to his uncle who admitted to the police that the gun had fallen out of his back pack when my boyfriend gave him a ride earlier in the week. I guess I am just wondering if someone can give me any idea of how much time he COULD be looking at? PLEASE SOMEONE HELP, HE GOES BACK TO COURT FOR PRELIMINARY IN TWO WEEKS.

Re: Probation and arrested for carrying a concealed weapon

You should be talking to his attorney about the potential sentence. If he does not have an attorney then you should be working with him to find an attorney. The gang enhancement alleges that he carried the concealed weapon for a gange purpose. That is to assist the gang in some activity.
