Legal Question in DUI Law in California

2nd DUI

I was arrested for my 2nd DUI in December and I had received my 1st one in 2005. SO I was charged with another DUI charge and a charge that was a felony. I am thinking the other charge of the felony is because I violated my probation period of the first one.I spent 3 days in jail and had court but I got an OR form and was let go. I have court on Feb.5th and I am scared that I may have to do more time. Can you please let me know as to what you might think would happen in court? Thanks!

I am not clear on why the new DUI is charged as a felony, and it may be possible to get it down to, and handle it as a misdemeanor. Yes, you face potential jail, depending on the facts, BA level, etc. However, with experienced counsel, that could be minimized or avoided with a plea bargain. That is what attorneys are for.
