It depends on how the DUI is charged. If it is felony, it can have dire consequences. If it is charged as misdemeanor, it will be taken in the totality of the circumstance, and in regards to your previous criminal history.

You are welcome to contact me at your convenience, I would be happy to dicuss this in further depth.

I agree with Mr. Hale. If the person is still in custody and if there is not an ICE hold on the person he/she should be bailed out immediately to decrease the chances of an ICE hold and deportation.

Possible deportation in addition to the criminal punishments. Get a lawyer. When arrested or charged with any crime, the proper questions are, can any evidence obtained in a test, search or confession be used against you, can you be convicted, and what can you do? If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a charge reduction, diversion, program, or other decent outcome through plea bargain, or take it to trial if appropriate.

If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help fight the criminal charges and get the best outcome possible, using whatever defenses there may be.
