Legal Question in DUI Law in California

How can my husband get a temporary license to go to work and DUI school.

It has been over 10 years since the last DUI and 12 since his first DUI. The court said he needed to obtain some form from the school and the school said it was to old and they could'nt give him this form for the DMV. Is there anything we can do?

It's not completely clear from your question, but I am assuming for purposes of this answer that you are referring to an abstract, which typically the DMV needs to re-issue a license.

You can petition the court, or file for an appeal with the DMV, typically, with our without an attorney.

Typically, to get a restricted license, you need proof of enrollment in the required alcohol class and proof of financial liability. This would be if you have not completed a required class.

The school will have the proof of enrollment form. If you have completed the class, you don't need a restricted license. You need to take the certificate of completion given by the school to the D.M.V.

Your question is not clear when you refer to something being "too old". What is too old? The school? If your husband has attended an approved school, and it still exists, he should get proof of completion of the class. If it doesn't still exist, he may need to take the class at another shcool.

You might call the D.M.V. Mandatory department in Sacramento and ask what they want in order to issue a license. If your husband has never completed a required alcohol class, they will require it, even after 10 years.
