Legal Question in DUI Law in California

husband's 1st ever dui

I am in the military currently in Texas. My husband lives in California and for the first time ever, received a DUI. He is well into adulthood, and has avery steble/goodjob. We are moving in @3months. What do you think the judge will order him to do? I have heared that not everyone that gets a DUI goes to jail (especially the first and only time). What are his options?

The answer depends entirely upon the facts of the case, the court and its policies, and the abilities of your husband's attorney. In California, assuming your husband does not go to trial, most first offense cases do not involve a jail sentence. If there are "enhancements", however, jail is a very real possibility. Examples of enhancements: high speed, prior convictions, refusal to take the chemical test, test results over .20%, presence of a child in the car, accident, etc. In addition to the criminal matter, of course, the DMV will suspend his driver's license for 4 months (or, if a refusal, one year).

He should retain a good DUI attorney to minimize the damage or, possibly, even get an acquittal or dismissal.
