Legal Question in Family Law in California

My 25 year old daughter is pregnant. What are the rights of the biological father before the child is born and after. They will not ever be married. The child will take my daughters last name

The bio father has the responsibility to provide support or the child and has the opportunity to establish a parenting timeshare based on the child's age and needs.

To answer your questions more specifically, before the birth he has essentially no rights. After the birth and until paternity is established he also has no rights. Paternity can be established by either of them filing a paternity determination case in court or as my girlfriend and I did by both parents signing a voluntary paternity declaration which the hospital can provide or later can be obtained from the county clerk. Once paternity is established, then the rights to custody visitation and child support will be the same as if they were getting a divorce.
