Legal Question in Family Law in California

Abortion and Child Support

My ex-girlfriend is pregnant because either the protection failed and/or by accident. We talked about abortion before and after she got pregnant. She agreed to having an abortion, but this time she won't and claims her doctor thinks it is unsafe. I have asked her repeatedly to look for alternatives, but she is now ignoring me.

Do I have any legal rights to have her have an abortion?

Is there anything I can do as I cannot have this baby?

What are my legal responsibilities if the baby is born?

Thank you for your time.

Reply: Abortion and Child Support

You can not force her to have an abortion. You will have parental rights as a father, and the obligation to pay child support for 18 years!

Good luck to you!

Re: Abortion and Child Support

She can have the baby if she wishes, and this also obligates you to pay child support until the child turns 18. It also means you have rights as a father regarding visits and custody.

Re: Abortion and Child Support

You cannot force her to have an abortion and you can be compelled to pay child support until the child is 18 yrs old. You may want to consider embracing her decision whatever it is and try making the best of the situation.
